PENALTIES AND PROCEDURE

Section 56: Disposal, on conclusion of trial for forest-offence, of produce in respect of which it was committed.

When the trial of any forest-offence is concluded, any forest-produce in respect of which such offence has been committed shall, if it is the property of Government or has been confiscated, be taken charge of by a Forest-officer, and, in any other case, may be disposed of in such manner as the Court may direct.

STATE AMENDMENTS Maharashtra Amendment of section 56 of Act 16 of 1927.—In section 56 of the principal Act, for the word “forfeited” the word “confiscated” shall be substituted. [Vide Maharashtra Act 21 of 2015, s. 7].

STATE AMENDMENT Jammu and Kashmir and Ladakh (UTs).— Section 56.-For the words “When the trial of”, substitute the words, figures and letter, “Without prejudice to the provisions of section 52C, when the trial of”. [Vide the Jammu and Kashmir Reorganization (Adaptation of Central Laws) Order, 2020, notification No. S.O. 1123(E) dated (18-3-2020).]
