How to file a consumer forum complaint
Under the Consumer Protection Act 2019, a consumer forum complaint is filed before the tier whose pecuniary limit covers the claimed amount. Here is what you need to know before you file.
Which forum receives your complaint?
The value of the goods or services (including the compensation claimed) determines which tier you file at. Filing at the wrong tier results in a return of the complaint.
- District Commission (DCDRC): complaints up to ₹50 lakh. One is present in every district.
- State Commission (SCDRC): complaints between ₹50 lakh and ₹2 crore. Also hears first appeals from the District Commission.
- National Commission (NCDRC): complaints above ₹2 crore. Also hears first appeals from State Commissions.
What a consumer forum complaint must include
There is no single prescribed form. A typed complaint on plain paper or via e-Daakhil (the online filing portal) is accepted if it covers these details:
- Name, address, and contact details of the complainant.
- Name and address of the opposite party (seller, service provider, or manufacturer).
- A clear statement of facts: what was purchased or contracted, what went wrong, and when.
- Supporting documents: purchase invoice, warranty card, service agreement, payment receipts, and all prior correspondence with the opposite party.
- The specific relief sought (replacement, refund, or compensation).
- A verification affidavit signed by the complainant confirming the facts are true.
